DELIVERY
We may arrange delivery of Physical Goods by courier or by Australia Post. We process deliveries promptly upon receipt of full payment.
Delivery of physical Goods within Australia may take: two (2) to fourteen (14) business days to despatch Goods in stock.
Delivery of physical Goods outside of Australia may take: thirty (30) to sixty (60) business days to despatch Goods in stock.
Any digital Goods are delivered immediately. You acknowledge and accept that there are inherent risks with downloading any digital Goods. Please contact Us using the details at the end of these Terms if You experience technical problems regarding delivery of digital Goods.
We take no responsibility for Goods that are lost or damaged during delivery, however we will provide tracking information.
We may choose in Our sole discretion whether or not to replace Goods which are lost or damaged during delivery.
Any disputes regarding physical Goods which are lost or damaged during delivery should be directly taken up with the relevant courier company or with Australia Post as applicable.
RETURNS/REFUNDS/REPAIRS

You agree that You will not share your Identifying Information with any third party and if You discover that Your Identifying Information has been compromised, You agree to notify Us immediately in writing.
You acknowledge that You are responsible for maintaining the safety and security of Your Identifying Information as well as keeping Us informed of any changes to Your Identifying Information.
You acknowledge that providing false or misleading information, or using the Items to further fraud or unlawful activity is grounds for immediate termination of these Terms.

Through Your use of the Product or other Items, You may provide Us with some of Your personal information. By using the Product or Items, You authorise Us to use Your information in Australia and any other country where We operate.
We take Our privacy obligations very seriously.

REVERSE ENGINEERING AND SECURITY
You agree not to:
- reverse engineer, or attempt to reverse engineer or disassemble any code or software from or on the Items; and
- violate the security of the Items through any unauthorised access, circumvention of encryption or other security tools, data mining or interference with any host, user or network.
SPAM POLICY
You are prohibited from using the Items for the purpose of gathering email addresses and/or personal information from people, companies or other organisations and/or for sending bulk emails or unsolicited emails.
GENERAL PROVISIONS
Australian Consumer Law: You may have certain rights, warranties, guarantees and remedies under the Australian Consumer Law, which is contained in the Competition and Consumer Act 2010 (Cth), and these rights, warranties, guarantees and remedies may not be restricted, modified or excluded by Us. Our liability to you is governed solely by these Terms and the Australian Consumer Law.
Applicable law: Your use of the Product and the Items is subject to the laws of Queensland, Australia and each party submits to the jurisdiction of the courts of Queensland, Australia.Written communication: In relation to any correspondence or notification which is required under these Terms to be provided in writing from one party to the other party:
- such notice is properly given if given to the other party:
- by email to an email address that the other party has nominated, acknowledged or used in connection with the use of the Product or other Items.
- by facsimile to a facsimile address which the other party has nominated, acknowledged or used in connection with the use of the Product or other Items.
- by post to a postal address the other party has nominated, acknowledged or used in connection with the use of the Product or other Items.
- such notice is taken to be received:
- if sent by email, when the email becomes capable of being retrieved by the recipient at the relevant email address.
- if sent by facsimile, at the time shown of correct and complete transmission to the recipient's facsimile number by the sending machine.
- If sent by prepaid post within Australia, five (5) days after the date of posting.
- if sent by prepaid post to or from an address outside Australia, twenty one (21) days after the date of posting.
No assignment: You must not assign, sub-licence or otherwise deal in any way with your rights under these Terms without Our prior written consent.
Severability: If any clause or sub-clause of these Terms is held to be invalid or unenforceable, it is to be read down or severed such that the remaining clauses and sub-clauses will be enforced to the maximum extent possible. In such circumstances, the remainder of these Terms shall continue in full force and effect.
No waiver: In the event that We fail to enforce any provision of these Terms, this shall not constitute a waiver of any future enforcement of that provision or of any other provision. Waiver of any clause or sub-clause of these Terms will not constitute a waiver of any other clause or sub-clause.
Headings for convenience only: Headings of clauses and sub-clauses under these Terms are for convenience only. Headings shall not affect the meaning of any provision of these Terms.
Parties must take all reasonable steps: Each party must, at its own expense, take all reasonable steps and do all that is reasonably necessary to give full effect to these Terms and the events contemplated by them.
Separate agreements: You may have other legal agreements with Us. Those other legal agreements are separate from and are in addition to these Terms. These Terms do not alter, amend, revise or replace the terms of any other legal agreements You may have with Us.

If something isn't quite right, then we need to sort it out with you. To provide the best short and long term service to our users, we have to ask a few questions.
Returns Approved
All unopened Treely® products are eligible for return within 15 days of delivery. For Storyteller Trees, this means that the all the parts must be in the correct location in the shipping box to be eligible for return. All Leaf Packs must remain in the original storage box, in their original position, and must be returned in the original outer packaging.
To initiate a return, please attach a picture of your unopened product and fill out the details requested below and email hello@treelyworld.com.
Once we approve the return, we can give you suggestions to ship back to Treely in Qld. We will only process a refund once we receive your returned products. The customer requesting a return for change of mind will be responsible for shipping costs to return any product.
Please note that returns do not apply to the following: Samples, donations, opened product, opened Trees products.
REFUND POLICY

This Refund Policy ("Policy") applies to all purchases from Treely, unless stated otherwise.
CUSTOMER SATISFACTION IS OUR PRIORITY
At Treely, The Trustee for Treely Trust, customer satisfaction is our priority.
We offer refunds, repairs and replacements in accordance with the Australian Consumer Law and on the terms set out in this Policy.
Any benefits set out in this Policy may apply in addition to consumer's rights under the Australian Consumer Law.
Please read this Policy before making a purchase, so that you understand your rights as well as what you can expect from us in the event that you are not happy with your purchase.
AUSTRALIAN CONSUMER LAW
(a) Under the Australian Consumer Law:
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
(b) We offer refunds, repairs, and replacements in accordance with the Australian Consumer Law.
(c) The Australian Consumer Law provides a set of Consumer Guarantees which protect consumers when they buy products and services.
(d) If the Australian Consumer Law applies, then we cannot avoid the Consumer Guarantees which it provides. If there is an inconsistency between this Policy and the Australian Consumer Law, the Australian Consumer Law will prevail.
(e) Further information about the Australian Consumer Law and these Consumer Guarantees is available from the website of the Australian Competition and Consumer Commission.
(f) If a product or service which you purchased from us has a major failure (as defined in the Australian Consumer Law) then you may be entitled to a replacement or refund. You may also be entitled to compensation for any reasonably foreseeable loss or damage resulting from that major failure.
(g) If a product or service which you purchased from us has a failure which does not amount to a major failure (as defined in the Australian Consumer Law) then you may still be entitled to have the goods repaired or replaced.
CHANGE OF MIND
(a) In the event that you receive the products or services which you purchased, as stated, but you simply change your mind, we may, at our discretion, offer you a refund or exchange provided that:
(I) You notify us within 15 days of receipt of Your order.
(II) In the case of products, you return the said product in its original packaging.
(III) In the case of products, the said product has not been opened.
(IV) In the case of products, the said product has not been used.
(V) In the case of products, the said product has not been damaged.
(VI) In the case of products, you return the said product with its original receipt.
(VII) In the case of services, the services have not already been performed.
(VIII) The following additional conditions are satisfied:
A fee of $100 per Tree or $20 per leaf kit will be charged top partially cover the cost of first time delivery. This will be deducted from the refund.
The customer must attach their details including name, address, order number, phone to the carton, arrange return delivery and notify Treely of the expected return date.
Upon receipt of the returned product, Treely can take up to 5 working days to process the refund. You will be notified by email of the refund.
PRODUCTS DAMAGED DURING DELIVERY
In the event that a product which you ordered is damaged during delivery:
(a) Please contact us as soon as possible.
(b) Any damaged product must be returned in the condition it was in when you received it, together with any packaging and other items which you received with the damaged product.
(c) We will organise to repair the damaged product or to collect it and replace it with an equivalent product, or to provide a refund, provided that you contact us within the following time from the date you received the product: 14 days
OTHER RETURNS
In addition, we may offer returns in the following circumstances:
Any individual parts (except cardboard leaves) that have been damaged or a faulty within 6 months of purchase will be replaced.
In order to be eligible for a return under these circumstances, you must:
Email a photo of the damaged part/s and Your order number. We use photos to help improve product design of future products.
Any claims for a return under this clause must be made within the following time from the date you received the product: 6 months.
EXCEPTIONS
Notwithstanding the other provisions of this Policy, we may refuse to provide a repair, replacement or refund for a product or service you purchased if:
(a) You misused the said product in a way which caused the problem.
(b) You knew or were made aware of the problem(s) with the product or service before you purchased it.
(c) You asked for a service to be done in a certain manner, or you asked for alterations to a product, against our advice, or you were unclear about what you wanted.
(d) Any other exceptions apply under the Australian Consumer Law.
SHIPPING COSTS FOR RETURNS
(a) In the event that a product you purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law we will bear any costs of shipping the said product (the "Returned Product") back to us, as well as any costs of shipping any replacement product to you.
(b) If the Returned Product can easily be posted or returned, then you are responsible for organising for the Returned Product to be returned to us. If the Returned Product is eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law) then we will reimburse you for the reasonable postage, shipping or transportation costs for the Returned Product.
(c) If the Returned Product is too large, too heavy, or otherwise too difficult to be removed and returned by you, and is believed to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then we will organise for the postage, shipping, transportation or collection of the Returned Product, at our cost.
(d) In the event that we organise and pay for the inspection, postage, shipping, transportation or collection of a Returned Product, and it turns out not to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then you will be required to pay the costs of any inspection, postage, shipping, transportation or collection of the Returned Product.
RESPONSE TIME
We aim to process any requests for repairs, replacements or refunds within 14 days of having received them.
HOW TO RETURN PRODUCTS
(a) You may contact us to discuss a return using the details at the end of this Policy.
(b) We will pay any refunds in the same form as the original purchase or to the same account or credit card as was used to make the original purchase, unless otherwise determined in our sole discretion.
(c) You must provide proof of purchase in order to be eligible for a refund, repair or replacement.
(d) You may be required to present a government issued identification document in order to be eligible for a refund, repair or replacement.
